Terms of Service

Summary

We, at Oxycon, provide the OxyLesson / Oxyconit service on a monthly or yearly subscription basis. Any image you upload to our service is your "media". Any digital content you upload is your "Content" — this may include text, images, audio, video, or other file types. Published Content may be viewable by other users.

You must respect third-party intellectual property rights. Only upload Content you have created or are licensed to use. Published Content becomes globally accessible when published and carries legal responsibilities. Do not upload prohibited items such as spam, viruses, or hate-promoting material.

Terms of Service

The use of Oxyconit websites, mobile applications, and services (the "Application") is governed by this Agreement. The Application is owned and operated by Oxycon and its affiliates. Your access and use are subject to these Terms, our Privacy Policy, Cookie Policy, and any other incorporated rules or policies.

Read the Agreement carefully. By accessing or using the Services you agree to be bound by these Terms. If you do not accept them, you must not use the Services. Services are intended for users aged 16 and over. If you are a parent or guardian and learn your child provided us personal information, contact us to take appropriate action.

Your Account

If you create an Account, you are responsible for securing it and for all activity occurring under it. Do not misuse or misrepresent data or another user's identity. Notify Oxycon immediately of any unauthorized access.

• You must have the rights to any third-party images or names used.
• You must comply with third-party licenses and pass-through terms when required.
• You must not resell, lease, or sublicense the Services.
• Do not bypass storage or promotion limits or abuse referral promotions.
• Content must be free from malware, spam, and unlawful or abusive material.
• Do not collect personally identifiable information about other users.

Your Licenses to Us

By submitting Content to Oxycon you grant us a global, royalty-free, transferable, sublicensable, non-exclusive license to use, reproduce, modify, adapt, publish, distribute, and promote the Content for purposes of providing and promoting the Services. We will make reasonable efforts to remove Content from our Services and promotional materials upon deletion, subject to residual copies.

This license survives termination for the period necessary to carry out the permitted uses. Users also receive a non-exclusive license to access and display Content in accordance with Service functionality. Licenses for product reviews and similar content may be perpetual.

Privacy

Our Privacy Policy explains how we collect, use, and share personal information and is incorporated into this Agreement. By using the Services you acknowledge having read it.

You are responsible for complying with applicable data protection and privacy laws when using the Services.

Protecting & Improving the Services

We may analyze Content and aggregated or pseudonymized personal information to improve and protect the Services. Where required by law, such processing will be described in our privacy disclosures.

Oxycon cannot review all posted material and is not responsible for Content accuracy, quality, or effects. Take precautions when downloading or interacting with Content.

Payment & Renewal

Subscription fees (monthly or annual) are charged in advance at the end of any trial period. Fees include applicable taxes and align with our Refund Policy. Fee amounts are fixed for the current subscription period but may change thereafter with at least 30 days' notice by email.

Unless you cancel prior to the end of the billing period, subscriptions automatically renew and you authorize charges to the payment method on file. Subscription cancellations are subject to our Refund Policy and can be requested via [email protected].

Payment Processing Partners

We use third-party payment processors (e.g., Stripe, Braintree, Przelewy24, iMoje). Their terms and privacy policies govern payment handling. You consent to charges processed by those partners and to us or processors correcting errors or discrepancies when necessary.

Interaction with Third-Party Services

Third-Party Services integrated with our platform (social networks, stock-image providers, payment platforms) operate under their own terms. We do not control them and are not responsible for your interactions with them. We may remove or restrict access to such integrations at our discretion.

Ownership of Intellectual Property

The Agreement does not transfer intellectual property from Oxycon to you. All Oxycon trademarks, logos, and service marks remain our property or that of our licensors. Your use of the Services does not grant rights to reproduce Oxycon or third-party trademarks.

Feedback

By submitting Feedback you grant Oxycon the right to use it without restriction. This does not affect any rights you hold under applicable laws.

Changes

Oxycon may amend the Agreement, Privacy Policy, or Cookie Policy at its discretion. We will notify Users by email or a prominent in-app notice. Continued use of the Services after such notice constitutes acceptance. If you disagree, your remedy is to stop using the Services.

If you stop using the Services and are a paid subscriber, we may provide a prorated refund for the unused portion of your subscription per the Refund Policy.

Termination

Oxycon may suspend or terminate accounts with or without cause. If your account is suspended, you may lose access to Content. Back up your Content; Oxycon is not liable for content loss resulting from suspension, termination, or account-type changes.

Disclaimer of Warranties

Services and Content are provided "as is". To the fullest extent permitted by law, Oxycon and its licensors disclaim all warranties, including implied warranties of merchantability and fitness for a particular purpose.

Limitation of Liability

Oxycon and its suppliers are not liable for special, incidental, consequential, or punitive damages, loss of data, or other damages arising from use of the Services except where prohibited by applicable law.

General Representation & Warranty

You represent and warrant that your use of the Services and any Content you provide will comply with the Agreement and applicable laws, including export and online conduct regulations.

Indemnification

You agree to indemnify Oxycon, its affiliates, and their respective officers, employees, and agents against claims and expenses, including attorneys' fees, arising from your use of the Services or breach of the Agreement.

Miscellaneous

This Agreement is the entire agreement between you and Oxycon regarding the Services. It is governed by the laws of the Province of Poland and subject to the exclusive jurisdiction of Polish courts, except as limited by applicable law.

If any provision of the Agreement is held invalid, the remaining provisions remain effective. Waivers must be in writing. Oxycon may assign its rights.

Account Limits

Oxycon may limit storage based on subscription plan and status. We will notify you when you near limits and attempt to increase limits when reasonable.

Refund Policy

You may terminate your account at any time. Cancellations stop future billing but do not relieve charges already incurred in the current billing period. Monthly subscriptions are generally non-refundable; please refer to our Refund Policy for details.
